Conditions of Use
1. General Provisions
Upere is new fashion brand established in 2012. Upere.com offers products from the Upere collections (the "Product(s)") for sale directly to its customers through this site www.upere.com (the "Site"). The sale of products on the site is subject to these terms and conditions of sale (the "Terms of Sale").
2. Information for Consumers
2.1. The products displayed on the Site are offered for sale to consumers only ("Consumer(s)" or "You"), that is any natural person who is acting for purposes which are outside his trade, business, craft or profession. The purchase of the products on the Site is only permitted by individuals who are 18 or over. The products offered for sale on the site can be purchased and shipped all over the world.
2.3. By submitting a purchase order You hereby accept and undertake to observe, these Terms of Sale. If You do not agree with any of the terms set out in the Terms of Sale, You should not submit an order to purchase products on the site.
3. Order Procedure and Accptance
3.1. To purchase a Product, you shall select the product(s) of interest, the color and the size. The Product(s) selected for purchase will be added to Your shopping cart. To have the option to save the items in your shopping cart so as to enable You to continue with the purchase at a later time, you must first create an online account and be logged into that account when making the purchase. It is possible to shop without an online account/without being logged in, but all items included in Your current shopping cart will be deleted if the purchase procedure is not completed and You will need to start a new purchase procedure when returning to the Site at a later stage.
3.2. You have the option to amend any of the information entered by You during the purchase process up until the point when You submit the order. Once the order is submitted You will not have the opportunity to amend or cancel the order.
4. Price and Payment
4.1. Prices of the products available for sale on the Site are displayed in USD ($) by default, GBP (£) for sales in the UK; and EUR (€) for sales to the European Union.
4.2. All prices of the Products for delivery will be inclusive.
4.3. Upere.com accept payments by MasterCard, Visa and American Express, Western Union, Wire Transfer.
4.4. The purchased product(s) will only be sent to the consumer after the consumer's payment card data has been verified or only after having received the charging authorisation from the consumer's bank. verification of the payment card data can cause delays, but will be kept to a minimum and normally don't require more than 24 hours, although it can be more. The consumer's payment card will only be debited after dispatch of the Product(s).
4.5. All products are supplied with an identifying card setting out an identification number which forms an integral part of the product concerned. You should not remove the identifying card and related identification number from the Product(s) until You have verified that the Product(s) conform to the order which You placed or until You decide not to exercise Your right of withdrawal under section 7 below.
5.1. The product(s) will be dispatched to the address provided during the purchase process. For security reasons, Upere.com will not accept any order where it is impossible to identify the individual recipient of the order, and the individual’s address.
5.2. All purchases will be delivered by Upere.com's selected courier service (DHL for UK and European Union) (the "Courier"), and the remote region will be delivered by EMS, unless stated otherwise for specific countries, between Monday and Friday excluding local or national holidays, after the shipping confirmation is sent to You, on the basis of the indicated availability. Saturday delivery may be available when offered by the courier. Conditions for delivery on Saturday will be presented at the time of offer.
5.3. Products will be delivered between 1 and 6 business days from the shipping confirmation if standard shipping has been chosen depending on your shipping address and destination country; and the method of shipping which You have chosen at the moment of purchase. Upere.com will not be responsible for delays that are unforeseeable and/or attributable exclusively to the Courier. Before we can dispatch your purchases, we may need to confirm your details with your card issuer. We will do our best to keep delays to a minimum and they normally don't require more than 24 hours.
5.4. Pre-order items will be dispatched as soon as they are available, as indicated on the website at the moment of placing the order. The customer will receive a Shipping Confirmation email as soon as the order is dispatched and delivery will take the same time as other orders, based on the type of delivery chosen.
6. Right of Withdraw
6.1. Consumers are entitled to withdraw from the purchase contract concluded with Upere.com without the payment of any penalty and without providing any reasons, within 14 (fourteen) business days from the date of receipt of the Product(s) purchased on the Site. When exercising the right of withdrawal Consumers are not allowed to change the purchased Product with another Product.
6.2. In order to exercise the Right of Withdrawal, Consumers are required to return the Product(s) in its original "as new" condition to the Upere.com Returns Centre (set out below at 7.8). All Products purchased online must be returned to the Upere.com Returns Centre. Returns sent to our stores will not be accepted.
6.3. A refund will be issued to the Consumer provided that the Products are returned unused, unwashed and in the same condition in which they were delivered, with all original labels attached, complete with all parts and accessories using their original packaging. In the event that the Consumer exercises its right of return for all the Products included in the same purchase order, all Products must be returned contemporaneously with the same shipment.
6.4. Upere.com reserves the right to inspect the Product(s) returned and to refuse the return of those Product(s), which it considers not compliant with the requirements specified under 7.3 above.
6.5. A full refund, excluding the original shipping costs, duties and taxes, will be issued to the same payment card used for the purchase as soon as possible and in any event, within 14 (fourteen) days from the date on which Upere.com has first acknowledged the receipt of the returned Product(s) sent by the Consumer, and provided that the conditions described under section 7.3 above have been met.
7. Changes to, and Correction of, the Terms of Sale
7.2. We will make all reasonable efforts to ensure that prices and other information about Products displayed on the Site are accurate and up-to-date. However there may occasionally be typographical errors, incorrect statements or omissions ("Errors") regarding the Product description, the price, promotions and offers and availability of the Product concerned. Upere.com reserves the right, at any time and without notice to You, to correct Errors, to change or update information, to revoke offers containing such Errors and to cancel any order at any time prior to shipment.
7.3. In the event that Your payment card is charged for an order cancelled pursuant to section 8.2, You will be promptly informed via email by Upere.com (in any event no more than 24 hours after the order has been cancelled) and a refund will be issued to Your payment card within 14 (fourteen) days of cancellation of the order.
7.4. All changes and/or corrections mentioned above will apply only to purchase orders submitted after the date of the change or correction effected by Upere.com.
8. Conformity of Orders
8.1. You must check the Product(s) at the time of delivery to ensure that they correspond with the Product(s) that You ordered.
8.2. Any anomalies identified at the time of delivery, including without limitation, any tampering or damage to the packaging, damage to the Product(s), missing items, non-conformity to the Product(s) ordered, defective Products, etc. ("Defects"), can be indicated by the Consumer directly to the Courier by inserting a written and signed comment on the delivery note provided by the Courier. In such circumstance the Consumer will not be required to accept the Product(s) and may return them directly to the Courier.
